Developer disclaimer
I. Legal independence
NearVisual operates as an independent provider of software engineering, web architecture and interface design. The Spanish statement describes a commissioned technical-work relationship with Dulcería Carlitos, with no employment subordination, partnership, joint venture or participatory association.
II. Commercial responsibility
The Spanish statement releases the developer from joint or subsidiary responsibility for the client’s commercial operations, including deliveries, product quality or safety, price-list accuracy, WhatsApp contracts and the truth or legality of content supplied by the client.
III. Technical warranties
The source code and web architecture are provided as is under the standards at deployment. No uninterrupted availability, absolute protection from zero-day attacks or indefinite compatibility with future browser or server changes is guaranteed.
IV. Ownership and licensing
NearVisual retains ownership of its libraries, reusable algorithmic logic and purpose-built UI components. The Spanish statement grants Dulcería Carlitos a perpetual, non-exclusive, limited license to use the assembled code on the agreed domain. Changes by people outside NearVisual end any remaining technical warranty.
V. Indemnification
The Spanish statement assigns Dulcería Carlitos responsibility for holding NearVisual and its engineers, directors or representatives harmless and indemnifying them against third-party civil, commercial, labor or criminal claims arising from commercial platform use, the owner’s privacy omissions or trademark disputes concerning supplied material.
VI. Law and disputes
The Spanish statement is governed by Mexican federal law. Disputes first go to out-of-court commercial mediation in Mérida, Yucatán; if no agreement is reached, they go to the competent commercial courts there. This English rendering follows the existing Spanish statement.
